1. Who these terms are with

Pipit is supplied by Resolve Security, New Zealand. “We” and “us” mean Resolve Security. “You” means the business that holds the account. These terms apply when you order hardware or open an account.

2. The service

Pipit provides vehicle tracking, compliance reminders, servicing schedules, driver scoring, sites and alerting through a web application and email.

Every feature is included in the monthly fee. There is no higher tier and no charge for the data your trackers send.

Your data is yours. We do not sell it, and we do not use it for any purpose other than providing the service to you.

7. Tracking people

If you use Pipit to track vehicles driven by your staff, you must tell them, have a lawful and fair reason for doing so, and meet your obligations as an employer and under the Privacy Act 2020.

This is not a formality. It is the obligation most often overlooked when a fleet starts tracking, and it sits with you rather than with us.

We work to keep Pipit available at all times, but we do not promise uninterrupted service. Maintenance, faults, network outages, mobile coverage, satellite reception and third-party failures can all interrupt it.

A tracker needs mobile coverage to report. In areas with no coverage, positions are stored on the unit where the hardware supports it and sent when coverage returns.

Pipit is a management tool, not an emergency or security response service. Do not rely on it as the sole means of recovering a vehicle or protecting an asset.

10. Liability

Nothing in these terms limits liability that cannot lawfully be limited.

Otherwise, and to the extent the law allows, our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period, and we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from a vehicle or asset not being recovered.

11. Consumer Guarantees Act

Where you acquire Pipit for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply, and that it is fair and reasonable to be bound by this. Where you are a consumer, your rights under that Act are not affected by anything in these terms.

We may update these terms. If a change materially affects you, we will give you 30 days' notice, and you may cancel before it takes effect if you do not accept it.

14. Law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
